Now that my tenant decided to give me an 8 day distinguish, can I legally keep the security deposit. We hold a month to month lease.

Yes, you can legally keep the security deposit. I own been nailed with this one by a long-gone land lord because i didn't know there was such a point as month to month agreement. Not only did he keep my deposit he took me to court and sued me for the next months rent as all right.
Comment: Did you have a stated amount of time to give notice to vacate written contained by your lease? If not, you go by the time set by the landlord/tenant laws for your area. some are 15 days, some 30, even 60. Depends on the nouns and type of rental: store space, primary living space, apartment, house, etc. I have never heard of anything less than 15 days, surrounded by which case you should be able to keep the sec. dep., unless the tenant agrees to pay packet a prorated rent amount to make up for the difference in time of notice.
Answer: You can keep hold of the deposit but next time have them to give you a 15 hours of daylight notice write it your contract.
