Am I Allowed To Get My Security Deposit Back If I Have No Moved In Yet?

I was going to move in but when i tried to clean the place in attendance was bugs and mice in there and very soon i don't wanna move in but the landlord will not give me my protection deposit back am i entitled to it?

Unfortunately, I think that you may not be entitled to your security deposit put a bet on. I would check with a local realtor -- they may be able to tell you, and but for they should be able to tell you who you can call.

The word is fit for human habitation and with vermin there is beyond a shadow of a doubt that the apartment is not habitable.  Since you caused no damage to his rental you are entitled to the return of your indemnity deposit.  Just make sure that you send him a certified letter complaining of the fleas as the reason for not taking possession.  To get your deposit back bring him to small claims court or go to Judge Joe Brown.  Make sure of your facts before filing including pictures of the mouse droppings and the bugs.
